This website is operated by Karpenko Gymnastics Academy PTE LTD ("KGA", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your relationship with KGA, including, but not limited to, your use of the KGA Website https://www.kga.sg/ (the "Website") and the KGA Mobile Application (the "App"), your purchase of KGA classes, your registration for classes, your purchase of merchandise, your communication with KGA, and your use of and attendance at KGA's studios. Intellectual Property Rights

The trademarks of KGA are proprietary to KGA and may not be used by you for any reasons other than as expressly permitted by these Terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, KGA. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.

Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of KGA, is strictly prohibited.

You acknowledge that KGA and/or third-party content providers remain the owners of all Website and App materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. KGA may discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.

Warranty Disclaimer and Limitation of Liability

In no event will KGA be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, the App, or on any other linked/third-party website, your purchase of KGA classes, your booking of classes, your purchase of merchandise, your communication with KGA, and your use of and attendance at KGA's studios, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if KGA expressly advised of the possibility of such damage.

All information, goods, services, products and experiences are provided by KGA on an "as-is" basis only. The entire risk as to the quality and performance of the goods, services, products and experiences remains with you. Should the goods, services, products and/or experiences prove defective after purchase, you assume the entire cost of such defect. KGA provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.

Choice of law

The Terms are governed by the laws of Singapore.

Acceptance of Terms

By using the Website or App, purchasing a KGA class, booking a KGA class, purchasing merchandise, and/or using or attending a KGA class, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a KGA class, booking a KGA class, and/or using or attending a KGA class. The purchase of classes from KGA Website or App are non-refundable and non-transferrable.

Occasional changes may be made to this document to reflect changes in KGA's policies. The Terms may be revised at any time by updating this posting. By using the Website or App, by buying KGA classes, booking classes, buying merchandise, and/or using and attending KGA's studios, you agree to be bound by any such revisions. KGA clients are encouraged to check this document periodically to stay informed of current guidelines.

I acknowledge and understand that by enrolling myself or my child(ren) at Karpenko Gymnastics Academy Pte Ltd., myself and/or my child(ren) will participate in physical activity including, but not limited to, gymnastics, tumbling, trampoline and dance (the “Activity” or “Activities”), by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Some Activities require quick movements involving speed, change of direction, height, and motion. Other Activities involve sustained physical exertion which places stress on the cardiovascular system. The specific risks vary from one Activity to another, but in each Activity the risks include, but are not limited to: minor injuries such as scratches, bruises, and sprains; major injuries such as loss of sight, joint or back injuries, broken bones, contusions, concussions, and heart attacks; and catastrophic injuries including paralysis, stroke, and death.

I understand the demands of the Activities and acknowledge that my or my child(ren)’s physical condition and skill level permits me or my child(ren) to participate in the Activities. I am aware of the type and severity of potential injuries resulting from my child(ren)’s participation in the Activities. Being fully aware of these dangers, I voluntarily consent and allow my child(ren) to participate in any and all Karpenko Gymnastics Academy Pte Ltd classes, programs, clinics, camps, and Activities and I VOLUNTARILY ASSUME ALL RISKS associated with or arising from that participation.

IN CONSIDERATION FOR ALLOWING MY CHILD(REN) TO USE THESE FACILITIES AND PARTICIPATE IN THE ACTIVITIES, I, ON MY OWN BEHALF AND ON BEHALF OF MY CHILD(REN) AND OUR RESPECTIVE HEIRS, ADMINISTRATORS, EXECUTORS AND SUCCESSORS, I HEREBY RELEASE, HOLD HARMLESS, AND COVENANT NOT TO SUE KARPENKO GYMNASTICS ACADEMY PTE LTD, ITS RESPECTIVE OWNERS, OFFICERS, AGENTS, ADMINISTRATORS, REPRESENTATIVES, EMPLOYEES, VOLUNTEERS, OTHER PARTICIPANTS, AND ALL OTHERS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES, INCLUDING, WITHOUT LIMITATION THOSE DAMAGES OR INJURIES RESULTING FROM ACTS OF NEGLIGENCE, SUFFERED BY MY CHILD(REN) AND ARISING FROM MY CHILD(REN)’S PARTICIPATION IN THE ACTIVITES.

I AGREE THAT IF THE CHILD(REN) IS A MINOR, THIS RELEASE OF ASSUMPTION OF RISK AND RELEASE OF LIABILITY AGREEMENT IS MADE ON BEHALF OF THAT MINOR CHILD(REN) AND THAT ALL OF THE RELEASES, WAIVERS, AND PROMISES HEREIN ARE BINDING ON THAT MINOR PARTICIPANT. I REPRESENT THAT I HAVE FULL AUTHORITY AS PARENT OR LEGAL GUARDIAN TO BIND THE MINOR CHILD(REN) TO THIS AGREEMENT.

I AGREE THAT IF THE CHILD(REN) IS A MINOR, I FURTHER AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS KARPENKO GYMNASTICS ACADEMY PTE LTD AND ITS AFFILIATES, FROM ANY AND ALL CLAIMS OR SUITS FROM PERSONAL INJURY, PROPERTY DAMAGE OR OTHERWISE WHICH ARE BROUGHT BY, OR ON BEHALF OF THE MINOR, WHICH ARE IN ANY WAY CONNECTED WITH SUCH USE OR PARTICIPATION BY THE MINOR, INCLUDING INJURIES, OR DAMAGES CAUSED BY THE NEGLIGENCE OR RELEASED PARTIES OR THIRD PARTIES, EXCEPT INJURIES OR DAMAGES CAUSED BY THE SOLE NEGLIGENCE OR WILLFUL MISCONDUCT OF THE PARTY SEEING INDEMNITY.

Karpenko Gymnastics Academy Pte Ltd, and it's owners, officers, agents, administrators, representatives, employees, and all others cannot guarantee that your child(ren) will not be exposed to or get COVID-19 should they come into contact with someone attending our facility. I have voluntarily chosen to allow my child(ren) to attend Karpenko Gymnastics Academy Pte Ltd and I'm aware of the contagious nature of COVID-19. I assume all risks with regards to my child(ren)'s participation in the Activities.

I understand that by allowing my child(ren) to attend Karpenko Gymnastics Academy Pte Ltd, I am exposing both myself and children to the risk of COVID-19. I understand and accept the risks that COVID-19 can cause serious illness, disability, and in some cases death and that exposure may come from myself, staff, or others attending Karpenko Gymnastics Academy Pte Ltd facilities.

I accept the risks and accept personal responsibility and liability for any injury, illness, including death to myself or my child(ren) should we contract COVID-19. I agree to release, not to sue, and forever discharge Karpenko Gymnastics Academy Pte Ltd, its affiliates, owners, staff, and all others from all liabilities, claims, damages, costs or expenses of any nature arising out of COVID-19 whether infection occurs before, during, or after participation at Karpenko Gymnastics Academy Pte Ltd. I understand that this releases any and all claims in regards to COVID-19 against Karpenko Gymnastics Academy Pte Ltd and its affiliates, owners, staff, and all others.

MEDICAL AUTHORIZATION AND FINANCIAL RESPONSIBILITY

In the event of an accident or emergency, I authorize Karpenko Gymnastics Academy Pte Ltd. to request emergency services to provide medical treatment and transportation for my Child(ren) to a hospital and I release and hold harmless Karpenko Gymnastics Academy Pte Ltd, and its owners, officers, agents, administrators, representatives, employees, volunteers, other participants, and all others in their execution of this matter. Additionally, I hereby acknowledge and agree that I am financially responsible for the cost of all medical treatment and transportation and other related expenses provided to my Child(ren) as a result of any injuries sustained while participating in the Activities at or for Karpenko Gymnastics Academy Pte Ltd. I further certify that my Child(ren) are covered by a medical insurance policy.
I hereby consent and authorize the Company to use photographs, and or other likelinesses of the Student and the Relevant Persons for any promotional materials regarding the Company’s programs, facilities or services or on the Company’s website. Additional General Terms and Conditions include:

All class packages are Non-Transferable & Non-Refundable.
By buying a package of classes, members automatically accept and agree to be bound by these conditions of membership.
KGA may withdraw use of all or part of the club for the purpose of undertaking maintenance work or any other work considered necessary for the upkeep of the premises.
Management reserve the right to refuse a package of classes to any individual without cause.
Classes will only be permitted to those who have paid for classes in advance.
You may, at your own discretion and expense, obtain personal insurance for loss, injury or damage that you might sustain arising from use of the facilities. You exercise at your own discretion and accept any injury or illness brought on by exercise is your own responsibility.
Anyone wishing to report on accidents, incidents, or problems with services at the club should contact the Duty Manager (simply ask at reception desk upstairs) or can email liam@kga.sg in confidence
any private class cancellation must be done by 6pm the day before class is due to start. If not then the class will be deducted from their credits

Kids Specific Class Terms & Conditions:

Coaches cannot bring children to the toilet. Please ensure they use the facilities before class starts
All kids must wear the KGA uniform during practice with black leggings or shorts. Clothing from other gymnastics clubs is strictly forbidden
Hair must be tied back for class
Parents are not allowed into the gym during class as it distracts the kids and for safe management measures also during pandemic times
Please be on time as being late may reduce your time to warm up which is essential to getting the most out of the session. Also, please be on time to collect your child
Please bring water to class to keep hydrated
